TERMS & CONDITIONS
THE ‘$2K GIVEAWAY’ PROMOTION
1. Information on how to enter the ‘$2K Giveaway’ promotion (the Promotion) held by The Play Way Pty Ltd trading as The Play Way (A.B.N.32 663 133 971) forms part of these terms and conditions of entry (Terms and Conditions).
2. Your participation in the Promotion is deemed acceptance of these Terms and Conditions.
3. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Promotion, these Terms and Conditions will prevail.
4. The promoter is The Play Way Pty Ltd trading as The Play Way (A.B.N.32 663 133 971) of 10-12 Woods Road, Yarrawonga, Victoria 3730 (the Promoter).
Promotion Period
5. The Promotion commences at 12:00AM AEDT on Tuesday 3rd December AEDT and closes at 08:00PM AEDT on Friday 13th December 2024 (Promotion Period).
Eligibility of entrants
6. Participation in the Promotion is open to all residents of Australia, who are aged 18 years and over, and who have made a fully paid purchase on The Play Way website between 12:00AM AEDT Monday 11th November and 08:00PM AEDT on Friday 13th December 2024.
Update: The promotion period has been extended to include all purchasers from 1 November at 12:00 AM AEDT to close at 08:00PM AEDT on Friday 13th December 2024.
7. Employees of the Promoter, and their friends and immediate families, are ineligible to participate in, or enter the Promotion.
Game of chance
The Promotion is a game of chance.
Prize
8. There is a total of one (1) prize to be awarded during the Promotion Period.
9. A valid winning entry will win one (1) ‘ $2000 Gift Voucher for The Play Way online store’ (the Prize).
10. Acceptance and use of any component of the Prize is subject to the full terms and conditions of use, as provided by the supplier of the Prize.
11. The total value of the Prize is up to $2000AUD.
12. The Prize is not exchangeable or redeemable for cash.
Drawing of Prizes
13. The winner of the Prize will be selected by a random draw that will take place at 10-12 Woods Road, Yarrawonga, Victoria 3730 at 08:00pm AEDT on Friday 13th December 2024.
14. Winners will be notified via the email address that they used to make their purchase on The Play Way website during the promotion period, within 48 hours of being announced as the winner of the Prize.
15. The Prize will be sent to the Winner within three (3) business days after the winner notifies the Promoter in writing that they wish to accept the Prize.
16. Subject to the unclaimed prize draw described in section 17, if for any reason a winner does not accept a prize within three (3) weeks of receiving notice from the Promoter that they are eligible to claim a prize, then that prize will be forfeited by the winner.
17. Subject to any directions from a regulatory authority, if a prize has not been accepted by the time stipulated by the Promoter, all non-winning entries from the original draw will be entered into a second chance draw which will take place no later than ten (10) business days following the lapse of the relevant deadline. The second chance draw will take place at the same place as the original draw.
18. The Promoter’s decisions are final and no correspondence will be entered into.
19. In order to claim the Prize, the winner must be able to prove that they were eligible to enter the Promotion at the time of submitting their entry. Failure to do so will result in them forfeiting the Prize.
20. After the Promoter has validated the winner of a Prize, that person will be contacted by the Promoter, notifying them of the Prize won and inclusions, along with further information on how to redeem the Prize.
General Conditions
21. The following general conditions apply to the entire Promotion.
Entries
22. The Promoter reserves the right, at any time, to verify the validity of all entries and the eligibility of all entrants, including their identity, age and place of residence. The Promoter reserves the right to disqualify any person who, in the opinion of Promoter, does not meet the eligibility criteria for the Promotion.
Prize
23. The Prize (and part thereof) is not transferable or exchangeable, and cannot be taken as cash, or used in conjunction with any other offer.
24. The Promoter will not be responsible (and an entrant will not be entitled to make any claim for compensation) for any variation of the Prize, or the value of it, during the Promotion Period, or thereafter.
25. If the Prize (or part thereof) becomes unavailable, the Promoter, in their discretion, reserves the right to substitute all or any part thereof, with a product or prize to the equal value and/or specification.
26. If an entrant’s contact details change during the relevant Promotion Period, it is the entrant's responsibility to notify the Promoter. If the winner of any prize is no longer contactable via the email address that we have on record, then they will forfeit the Prize and there will be no redraw.
27. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality and/or the suitability of the Prize.
28. All values and amounts that appear in these Terms and Conditions are inclusive of GST, unless expressly stated otherwise.
Entries
29. The Promoter may, in their absolute discretion, but subject to any relevant law, modify, suspend, cancel or recommence the Promotion, as appropriate, if:
a. for any reason, this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical or software failures or any other causes beyond the control of the Promoter, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion; or
b. the entry process, the determination of the winner of a Prize is prevented or hindered by any outside agent or event, including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
30. Where the Promoter modifies, suspends, cancels or in any way amends the Promotion, the Promoter will provide notice of this via email.
Limitation of Liability
31. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following:
a. Any variation in value of the Prize;
b. The Prize, or use of the Prize; or
c. Participation in the Promotion.
32. Paragraph 31 above does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
Use of personal information
33. Any personal information that may be collected for the purpose of conducting the Promotion will be handled in accordance with The Play Ways’ Privacy Policy and will not be shared with any third party.
Publicity
34. By accepting the Prize, the winner of the Prize consents to the Promoter using their name, biographical details, likeness, image and/or voice including winning entry submission (including photograph, film and/or recording of the same) in any media, including both online and offline media, for an unlimited period without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter.
General
35. If any term or condition contained herein shall be or become illegal, invalid or unenforceable, the same shall be read down, if such reading down is possible, and if found to be impossible, shall be severed and the remaining terms and conditions shall not be affected.
36. These Terms and Conditions are to be interpreted in accordance with the laws of Victoria and all parties submit to the non-exclusive jurisdiction of those Courts.
